After all, the new rules are about transparency and who doesn\u2019t want to be told the truth?<\/p>\n<p>Yes, there may be some customers who decide not to give their consent, so you cannot send them marketing messages by SMS; however this isn\u2019t a bad thing \u2013 if you\u2019re only reaching out to customers who want to hear from you, engagement will be much higher.<\/p>\n<p>To be sure that you\u2019re collecting consent in a way that is compliant with the new data regulations, you must ensure:<\/p>\n<p>\u2022 It is clear exactly what is being opted in to<br \/>\n\u2022 Consent can be documented and evidenced if challenged<br \/>\n\u2022 It is easy for customers to withdraw consent at any time<\/p>\n<p><a href=\"https:\/\/www.firetext.co.uk\/blog\/wp-content\/uploads\/2018\/01\/logo.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-2257\" src=\"https:\/\/www.firetext.co.uk\/blog\/wp-content\/uploads\/2018\/01\/logo.png\" alt=\"Be clear with your opt-ins for SMS campaigns \" width=\"500\" height=\"400\" srcset=\"https:\/\/www.firetext.co.uk\/blog\/wp-content\/uploads\/2018\/01\/logo.png 1000w, https:\/\/www.firetext.co.uk\/blog\/wp-content\/uploads\/2018\/01\/logo-300x240.png 300w, https:\/\/www.firetext.co.uk\/blog\/wp-content\/uploads\/2018\/01\/logo-768x614.png 768w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>The ICO have specified that, for organisations relying on consent you \u201ccannot rely on silence, inactivity, pre-ticked boxes, opt-out boxes, default settings or blanket acceptance of your terms and conditions\u201d as proof of consent, so make sure it is NOT:<\/p>\n<p>\u2022 Collected using a pre-ticked box<br \/>\n\u2022 Bundled in to other offerings<br \/>\n\u2022 Assumed or defaulted<\/p>\n<p>Not only must the consent given conform to the new regulations, but there also must be proof and data controllers \u201cmust have an effective audit trail of how and when consent was given, so organisations can provide evidence if challenged\u201d this applies to anyone managing data, regardless of how that consent was obtained.<\/p>\n<p>There&#8217;s lots of information and resources on both the <a href=\"https:\/\/dma.org.uk\/gdpr\">DMA<\/a> and <a href=\"https:\/\/ico.org.uk\/media\/1624219\/preparing-for-the-gdpr-12-steps.pdf\">ICO<\/a> websites if you need help preparing for GDPR.
